These Terms of Service explain how this website and my services can be used. They are here to keep expectations clear, protect both sides, and make sure every project starts with a shared understanding of the process, responsibilities, and limitations.
1. Overview
These Terms of Service govern any design engagement between Super Retro Studio (ABN: 60248340397), a sole trader operating as “Super Retro Studio” (“we,” “us,” “the studio”), and the client engaging our services (“you,” “the client”). By engaging our services, submitting a brief, or making payment, you agree to these terms. A full and complete design contract is sent with every project and may or may not include additional information that is not included in this "terms of service" document.
2. Project Structure
All projects are delivered in stages, as outlined in the applicable pricing tier (Foundation, Signature, or Extended) and confirmed in your project proposal and design contract.
3. Payment Structure
Each project stage requires two payments:
50% deposit, due before work on that stage begins and,
The remaining 50% of the current stage, which is due before work proceeds to the next stage or before final delivery of that stage’s outputs
Work will not commence on a new stage until the previous stage’s final payment has been received in full unless a prior arrangement has been made in writing and agreed upon by the studio.
4. Revisions
Each pricing tier includes a set number of revision rounds, as specified at the time of proposal (2 rounds for Foundation, up to 3 for Signature, unlimited priority for Extended, within acceptable industry limits). Revision rounds do not roll over between stages and expire at the completion of each stage. Requests beyond the included rounds will be quoted separately and payment will be required before revisions outside of scope will proceed.
5. Cancellation & Refunds
Either party may cancel a project with 30 days’ written notice.
If the client cancels:
The initial 50% deposit for the current stage is non-refundable
A partial refund of any additional payments made for that stage will be calculated based on the percentage of work completed at the time of cancellation, at the studio’s reasonable assessment
Work delivered up to the point of cancellation remains the property of the studio until final payment for that stage is received (see Section 6)
6. Intellectual Property & Ownership
All design work, concepts, and files remain the property of Super Retro Studio until final payment for the relevant stage has been received in full. Upon final payment, ownership of the final, approved deliverables for that stage transfers to the client.
Concepts, drafts, and unused directions not selected by the client remain the intellectual property of Super Retro Studio and may not be used, reproduced, or claimed by the client.
7. AI & Machine Learning Restrictions
At no point does Super Retro Studio grant permission for any artwork, designs, files, or deliverables produced under this engagement to be used as training data for generative AI, large language models (LLMs), or any other machine learning system, whether by the client, a third party, or an automated tool the client uses. This restriction applies regardless of the ownership transfer outlined in Section 6, and survives the completion or termination of the project.
8. Client Responsibilities
The client agrees to provide timely feedback, requested materials, and approvals to keep the project on schedule. Delays caused by the client (late feedback, missing materials, delayed sign-off) may extend project timelines and are not the responsibility of the studio. Such delays do not constitute grounds for a refund, discount, or dispute of fees under Section 5.
We ask that any concerns about a project be raised with us directly during the engagement so they can be addressed as they arise, rather than after the fact in the form of negative review or otherwise.
9. Liability
Super Retro Studio’s liability in connection with any project is limited to the amount paid by the client for that project. We are not liable for any indirect, incidental, or consequential losses, including loss of profits, business, or data, arising from the use of delivered work as outlined by this terms of service agreement and in the design contract issued at the beginning of the project.

These terms are governed by the laws of New South Wales, Australia.
